Agreement to these terms
These Terms of Service govern your use of the BREATHmg website, digital products, customer accounts, My BREATHmg, downloads, military access, nonprofit access, and related services. By purchasing, creating an account, accepting an invitation, or using the service, you agree to these terms and the Privacy Policy.
Educational wellness service
BREATHmg provides educational breathwork instruction and wellness tools. It is not medical care, diagnosis, treatment, psychotherapy, emergency support, or a substitute for advice from a qualified healthcare professional.
Review the safety guidance before practicing. Practice seated or lying down. Never practice while driving, in water, or anywhere dizziness could create danger. Never force a breath or hold. Stop and return to normal breathing if you feel dizzy, lightheaded, unwell, distressed, or uncomfortable. Seek professional guidance before beginning if you have a medical condition, are pregnant, take medication that affects breathing or cardiovascular function, or have concerns about whether breathwork is appropriate for you.
Accounts
You are responsible for providing accurate information, maintaining the security of your account, and using the service lawfully. Do not share account credentials or attempt to access another person's private history or Awareness Notes. Contact BREATHmg promptly if you believe an account or invitation has been used without permission.
Purchases and access
- Individual: one permanent seat for a one-time payment of $39.
- Breath Buddies: four permanent seats for a one-time payment of $99. The purchaser receives one seat and may invite three other people.
Neither option is a subscription. The 60-day program describes the guided path, not an account-expiration period. Purchased access does not expire at day 60. Downloaded files may be kept for personal use, and the program may be repeated.
License and acceptable use
BREATHmg grants each authorized seat holder a limited, personal, non-exclusive, non-transferable license to use the program, audio, guides, downloads, and account features for personal educational wellness use. You may not copy for redistribution, sell, sublicense, publish, publicly perform, upload, scrape, reverse engineer, or use the materials to create a competing product or training program.
A Breath Buddies purchase includes four named-user seats, not a license to share files or one login with an unlimited number of people. Nonprofit and organizational use is governed by the access arrangement approved for that organization.
Breath Buddies
Buddy features are intended for supportive accountability. Members may see top-line activity, last check-in information, and messages intentionally shared with the circle. Detailed practice history and Awareness Notes are private. Do not use Buddy features to harass, threaten, shame, impersonate, disclose another person's confidential information, or provide medical advice.
User content
You retain ownership of text you enter in Awareness Notes or intentionally share with a Buddy circle. You grant BREATHmg the limited rights needed to store, process, transmit, display, and back up that content to operate the requested feature. Private Awareness Notes are not displayed to Buddies. Shared messages are visible to the intended circle.
Military and nonprofit access
Military access is offered in good faith to active-duty service members and veterans for their own use. A person requesting access must truthfully complete the honor declaration and may not misrepresent eligibility.
Nonprofit requests are reviewed separately. Approval, seat count, delivery method, and permitted organizational use depend on the organization, audience, group size, and intended use. Submitting a request does not guarantee approval.
Refunds
Paid purchases are covered by the 30-day money-back guarantee described in the Return Policy. Submit a request within 30 calendar days of purchase. No reason is required.
Availability and changes
BREATHmg may maintain, update, improve, or replace parts of the website and account experience. Purchased account access does not expire merely because a 60-day cycle ends. Temporary maintenance, technical failures, security work, or events outside reasonable control may interrupt online availability. Permanent downloads are provided so the purchased program remains useful offline.
Intellectual property
BREATHmg and its program structure, text, audio, visual design, software, guides, names, marks, and other original materials are owned by or licensed to BREATHmg and are protected by applicable intellectual-property laws. These terms do not transfer ownership.
Third-party services
The service may rely on Shopify, payment providers, email providers, hosting providers, analytics services, and other vendors. Their services may be subject to separate terms and privacy notices. BREATHmg is not responsible for a third-party service outside its reasonable control.
Disclaimers
To the maximum extent permitted by law, the service is provided on an as-available basis without warranties not expressly stated in these terms. Individual responses to breathwork vary. BREATHmg does not guarantee a specific physical, mental, emotional, clinical, or performance outcome.
Limitation of liability
To the maximum extent permitted by law, BREATHmg will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the service. Nothing in these terms limits liability that cannot legally be limited.
Suspension or termination
BREATHmg may suspend or terminate access for fraud, payment reversal, material misuse, unlawful activity, unauthorized redistribution, threats to other users, or attempts to compromise the service. When reasonable, BREATHmg will provide notice and an opportunity to resolve the issue.
Governing law
These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles. Mandatory consumer protections that apply where you live are not waived.
Changes and contact
These terms may be updated to reflect product, legal, security, or operational changes. The current version will be posted with an updated date. Questions may be submitted through the Contact page.
